Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Capsicum by Illuminated Bits mobile application (the "App") operated by Illuminated Bits LLC ("us", "we", or "our").

Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. By accessing or using the App you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the App.

Improvements and Changes

We and our third party providers may make improvements and/or changes to the App at any time without notice. We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, the App or any portion thereof with or without notice. You agree that we shall not be liable to you or to any third party for any modification, suspension or discontinuance of the App or any portion thereof.

To use some services of the App, you are required to create an account with an email address (“User Data”). You agree to provide accurate information. You agree that we may use your User Data to provide services on the App for which you have expressed interest. If you provide any information that is inaccurate, or we have reasonable grounds to suspect that such information is inaccurate, we have the right to suspend or terminate your account and refuse any and all current or future use of the App.

Age and Legal Restrictions

In consideration of your use of the App, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of any applicable jurisdiction.

Some parts of the App are billed on a subscription basis ("Subscription(s)"). Your payment will be charged to your iTunes account at confirmation of purchase. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycle is set on a monthly or annual basis.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it at least 24 hours before the next Billing Cycle.

Cancellations do not take effect until the end of the current Billing Cycle. You may cancel your Subscription renewal through your iTunes account management page.

User Conduct

You are solely responsible for maintaining the confidentiality of the password associated with your account and for restricting access to your password while logged into the App. You accept responsibility for all activities that occur under your account.

We endeavor to use reasonable security measures to protect against unauthorized access to your account. We cannot, however, guarantee absolute security of your account, your Content or the personal information you provide, and we cannot promise that our security measures will prevent third-party “hackers” from illegally accessing the App or its contents. You agree to immediately notify us of any unauthorized use of your account or password, or any other breach of security, and to accept all risks of unauthorized access to the User Data and any other information you provide to us.

You understand that all information, data, text, photographs, graphics, or other materials (“Content”) added to the App are the sole responsibility of the person from whom such Content originated. This means that you, and not us, are entirely responsible for all Content that you upload, transmit or otherwise make available via the App. We do not control or monitor the Content posted to the App by others and, as such, do not guarantee the accuracy, integrity or quality of such Content. Under no circumstances will we be liable in any way for any Content.

Content Submitted to the App

We do not claim ownership of Content you submit in the App. Data is encrypted when stored on our server and is not readable by us. Please read our Privacy Policy for more details.

Proprietary Rights

You acknowledge and agree that the App, any necessary software used in connection with the App (if any) and any Content available on the App contain proprietary and confidential information that is protected by applicable intellectual property and other laws. Except as expressly permitted by applicable law or authorized by us or applicable third party service providers or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the App, the software or Content available on the App (other than Content that you may submit), in whole or in part.

We grant you a personal, non-transferable and non-exclusive right and license to access and use the App; provided that you do not (and do not allow any third party to) copy, modify, create a derivative work from, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the App. You agree not to access the App by any means other than through the interface that is provided by us for use in accessing the App.

The term "Capsicum", the Capsicum logo and other Illuminated Bits logos and product and service names are property of Illuminated Bits LLC, and you may not use or display these in any manner without our prior written permission. Any third party trademarks or service marks displayed on the App are the property of their respective owners.
